The petitioners have filed the present writ application praying for a direction upon the respondents to disclose whether any purported lookout circular against the petitioner nos. 2 , 3 and 4 have been issued and also prayed for quashing and setting aside of any lookout circular issued against the petitioners at the instance of the respondents.

2. As per the direction passed by this Court, the learned counsel appearing for the UCO Bank has submitted the request dated March 31, 2022 addressed to the Deputy Director, Bureau of Immigration requesting for issuance of lookout circular against the petitioners herein.

3. Learned counsel for the Bank submits that as per the request made by the Bank, the lookout circular was issued on March 21, 2022. Learned counsel for the Bank submits that though the Bank has requested the Bureau of Immigration for issuance of look out notice but no

proceeding has been initiated against the petitioners either for willful default or declaring fraud of the account of the petitioners as fraud except recovery proceedings.

4. Learned counsel for the petitioners submits that no case is pending against the petitioners.

Learned counsel appearing for the Union of India has handed over the office memorandum dated February 22, 2021 and submits that as per Clause 6 (J) the lookout circular opened shall remain in force until and unless a deletion request is received by the Bureau of Immigration from the originator itself. No LOC shall be deleted automatically. Originating agency must keep reviewing the LOCs opened at its behest on quarterly and annual basis and submit the proposals to delete the LOC, if any.

6. Heard the learned counsel for the respective parties, perused the materials on record.

The Bank has made a request to the Bureau of Immigration for issuance of lookout notice on March 31, 2022 but this Court finds that before receipt of the said request, the LOC has been issued against the petitioners on March 21, 2022. It is the case of the Bank that no proceeding has been initiated against the petitioners either for willful default or for declaring the amount fraud. It is also admitted that no case is pending against the petitioners.

8. Considering the above, this Court finds that there is no investigation initiated against the petitioners, no proceeding declaring the petitioner as willful default or

fraud is initiated except recovery proceeding and no investigation report is filed.

9. Accordingly, the lookout circular dated March 21, 2022 is set aside and quashed.

10. WPA 26384 of 2025 is disposed of.

11. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
