Learned advocate appearing for the petitioner submits that the petitioner is in custody for 180 days. Learned advocate draws the attention of the Court to the findings of the investigating officer in the report under Section 173 Cr.P.C. relating to the complicity of the present accused. It was emphasised that the petitioner is innocent of the charges and has been falsely implicated in connection with the instant case.
Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that this petitioner had dropped the accused person who committed the offence and subsequently picked up the accused person. According to the State, the conspiracy is completely proved so far as the present petitioner is concerned.
Be that as it may, the charges are yet to be framed in
connection with the instant case. Accordingly, at this stage, I am not inclined to release the petitioner on bail. Thus, CRM(M) 2411 of 2025 is dismissed at this stage. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
