The Union of India and others Mr. Kartick Kumar Bhattacharyya, Ms. Soumashree Dutta .... for the petitioner Mrs. Indrani Chakraborty .... for the Union of India Despite the present application being directed against alleged inaction of the Central Information Commission situated at New Delhi, since the cause of action arises in Kolkata, the writ petition is entertained by this court.

Learned counsel for the petitioner contends that despite having applied for relevant information on the allegation that the petitioner's brother, a third party to the litigation, has been siphoning off amounts by fraudulently opening a joint account in the name of the said third party and the petitioner's father (since deceased), such information has not yet been made available to the petitioner.
Ultimately, the petitioner had to approach the second appellate forum, where the petitioner's challenge is still pending for a long time.
Hence, the petitioner seeks a direction on the Central Information Commission to expedite the hearing to the petitioner's challenge to ensure that the petitioner gets the information at the earliest. Learned counsel appearing for the respondentauthorities submits that the second appeal is still pending before the Central Information Commission (CIC).
Upon hearing learned counsel for the parties, WPA No. 26344 of 2022 is disposed of by directing the Central Information Commissioner, New Delhi to decide the appeal pending at the behest of the petitioner, upon giving adequate opportunity of hearing to the petitioner and in accordance with law, as expeditiously as possible, preferably within two months from date positively.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
