As directed by the order dated January 02, 2020 Mr. Debasish Chakraborty, learned advocate, appears before this Court in virtual mode.
Mr. Chakraborty submits that he did not or attempted to do anything to affect the dignity of the Court of learned Additional District Judge at Baruipur but if any of his conduct and/or submission injures the high office of the learned Judge that was not intentional and he tenders unqualified apology for the same.
In view of such stand being taken by Mr. Chakraborty, this Court is not inclined to stretch the said issue. The appearance of Mr. Chakaraborty in the matter is no more required. The observations made against Mr. Chakraborty in the order dated September 26, 2019 in Misc. Appeal No. 14 of 2019 are hereby expunged.
Mr. Jayanta Samanta, learned advocate appearing on behalf of the petitioners, submits that the issue since has been resolved, his clients are not willing to press this application under Section 24 of the Code of Civil Procedure. He files a written instruction of his clients to the said effect which is taken on record.
In view of the aforesaid, CO 4405 of 2019 is dismissed as not pressed.
No order as to costs.
The appeal Court below is requested to expedite the disposal of the connected Misc. Appeal No. 14 of 2019. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
