1. The limited grievance of the petitioner is that the petitioner's husband met his sad demise on December 6, 2020. However, the repeated representations of the petitioner for disbursal of the insurance claim have fallen on deaf ears.

2. It transpires that despite service, none appears for the respondent no. 4, that is, the Branch Manager, Manipal Cigna Health Insurance Company Limited, who is the main contesting party, at the time of call. Affidavitof-service filed in Court today be kept on record.

3. Be that as it may, in view of the innocuous nature of the prayer made in the writ petition,

the matter is taken up for hearing in the absence of the said respondent.

4. Accordingly, WPA No. 26353 of 2022 is disposed of by directing the respondent no. 4 to immediately look into the petitioner's claim for insurance, which has been ventilated in the present writ petition, by deciding the representations given by the petitioner annexed to the writ petition, positively within a fortnight from the date of communication of this order to the said respondent.

5. It is made clear that the petitioner shall, while communicating this order along with a server copy thereof, also hand over a further copy of the writ petition to the respondent no. 4 to enable the said respondent to decide the issue effectively.

6. The respondent no. 4 shall act on the server copy of this order and shall decide the issue within a fortnight from handing over the said documents and immediately thereafter communicate his decision to the petitioner.

7. In the event there is no impediment to the disbursal of the amount, it is expected that the respondent no. 4 shall ensure that the claim of the petitioner is disbursed at the earliest, positively within one month from the date of

the decision being taken by the respondent no. 4.

8. There will be no order as to costs.

9. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
