01.12.2022 sdas rejected C.R.M. (NDPS) No. 1422 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Swarupnagar Police Station Case No. 1063 of 2019 dated 10.12.2019 under Section 21(c) of the NDPS Act.

In Re : Saddam Sardar ... petitioner Mr. Mrityunjoy Chatterjee ...for the petitioner Mr. Sanjoy Bardhan Mrs. Baishakhi Chatterjee ....for the State Learned Counsel appearing for the petitioner submits he is in custody for six months. He prays for bail. Learned Counsel appearing for the State opposes the prayer for bail and submits trial is at its fag end and the date has been fixed.

We have considered the materials on record. There are materials connecting the petitioner with the alleged offence involving possession of narcotic substance above commercial quantity.

In view of the aforesaid circumstances and the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.
