The report so submitted reflects that the trial of the case is in progress. No materials could be substantiated that the witnesses who have been examined have withheld any evidence or they have been declared as hostile. The apprehension of the present petitioner at this stage do not seem to be substantiated by reasons but only on certain experiences which he apprehends. Having considered the same, I am of the view that the prayer so advanced before this court cannot be acceded to. However, if the

witnesses or the petitioner feel that they are being threatened, victimized or there are circumstances which are being created which instills fear within themselves that they will not able to participate in the court proceedings. In that case, if an information is sent to the Inspector-in-Charge/Officer-in-Charge of Jamalpur PS or a superior officer in charge of Jamalpur PS, adequate police protection be provided till the end of the trial of this case to the petitioner or any of the witnesses who are to appear before the court.

As there is already a direction by the Hon'ble Supreme Court in Special Leave to Appeal being Crl. No.4108 of 2022 to expeditely conclude the trial, learned trial court would fix a schedule each and every month and take the trial to its logical conclusion. With the above observations, the present revisional application being CRR 4357 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
