His appearance may be regularised by the concerned authority.

The grievance of the petitioner is regarding the manner in which the proceedings are progressing before the ld. CJM, Paschim Medinipur.

Ld. advocate submits that there has been no progress in the whole year of 2022 and 2023, although charge-sheet was submitted in the month of December, 2021 and copies of the same have been served. Having regard to the submissions so advanced by the ld. advocate appearing for the petitioner, I direct that on the next date so fixed in the month of February, 2024, the ld. trial court would take all efforts for commitment. In the event, the same is not possible, in that case, the ld. trial

court would modify the conditions of bail to the extent that the appearance of all the accused persons are ensured on the next date so fixed, which would be within a month from the next date. By 31st of March, 2024 the proceedings arising out of Kharagpur (L) P.S. Case No. 479 of 2021 dated 09.07.2021 should be committed to the ld. Sessions Judge having jurisdiction.

The ld. Sessions Court either itself or through any other Court within the jurisdiction take steps for progress in respect of the trial of the case.

Accordingly, all efforts be taken in the proceedings relating to consideration of charges being completed by 31st of June, 2024. Thereafter, the ld. trial court would fix a schedule of three dates and fix such schedule on each and every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, CRR 4361 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
