It appears that an advance copy of the report as directed by order dated 21st November, 2016 has been circulated to the petitioner by the respondent nos.6 & 8. It appears from the said report that since the originally selected candidate did not join the post in question, the Pradhan, Poragacha Gram Panchayat in concurrence with the BDO has appointed a person to function as VLE. Admittedly, the said person has not been selected through any process of recruitment.

In these circumstances, the appointment of the private respondent no.10 shall stand set aside.

The BDO and the Pradhan of the concerned Gram Panchayat shall undertake a formal recruitment process to the post of VLE in the Poragacha Gram Panchayat under Kulgachi Police Station, District: Nadia within a period of two months from the date of communication of a copy of this order. The private respondent no.10 may however, be engaged on an ad-hoc basis for a period of two months only. With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
