Report filed by the State is also taken on record. Learned advocate for the petitioner submits as follows. The petitioner is the owner of the property in question. The private respondent has been disturbing the possession and enjoyment of the property by the petitioner. No FIR was lodged on the complaint of the petitioner.

Learned advocate for the private respondent denies the allegations made in the writ petition.

Learned advocate for the State relies on the report and submits that the prime grievance has already been redressed. A specific FIR being Ranaghat PS Case No.706/23 dated 05.11.2023 under Sections 341/379/506/34 of the Penal Code has been started.

As the prime grievance of non-registration of FIR has already been redressed, no further order need be passed in this regard.

Let the investigation be concluded expeditiously and in accordance with law.

However, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. With these observations, the writ petition is disposed of.

As affidavits were not called for, the allegations made are deemed not to have been admitted.

Urgent certified copies of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
