1. Affidavit-of-service filed by the petitioner is retained with the records.

2. The petitioner claims to the Secretary of a club, which conducts a fair every year from 25th November, 2023 for a period of twenty days.

3. The petitioner has annexed document to show that permission for conducting the fair was given for the last two years.

4. For the current year application has been made before the Pradhan and the Block Development Officer who also happens to be the Executive Officer of the Panchayat Samity with request to issue the permission for conducting the fair. Steps have not been taken till date.

5. The ultimate authority to issue the permission for conducting the fair is the Executive Officer of

Murshidabad Zilla Parishad, the respondent no. 5 herein.

6. The instant writ petition is disposed of by directing the Executive Officer of the Murshidabad Zilla Parishad to take into consideration the petitioner's prayer for grant of permission for holding the fair in accordance with the prevailing rules, subject to compliance of all necessary formalities.

7. Steps for consideration of the petitioner's prayer shall be taken at the earliest but positively within 16th November, 2024.

8. If the petitioner's prayer is disallowed, then an order disclosing the reasons for not allowing the prayer of the petitioner shall be communicated immediately thereafter.

9. The writ petition stands disposed of.

10. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
