Learned advocate appearing for the petitioner submits that the petitioner has been implicated on the basis of statement of the co-accused and the subject matter of the case relates to recovery of 298 bottles of Phensedyl from the house of co-accused. The petitioner prays for bail on any stringent conditions.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the petitioner did not cooperate with the investigation. It has also been contended on behalf of the State that the Bank details as well as the mobile phone number was not provided consequent to which the money trail or the connection with the principal accused could not be ascertained by the

prosecution. However, it has been submitted that the charge sheet has been filed before the jurisdictional Special Court. Having regard to the quantum of seizure and the period of detention, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Jasim Sk @ Josim Sk @ Jasom Sk. shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act cum learned Additional District & Sessions Judge, 3rd Court, Special Court, Malda.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 1480 of 2025, is, thus, disposed of.

Report filed by the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
