Mr. Kallol Basu, Mr. Anupam Hait, Mr. Nilanjan Pal ....for the petitioners Mr. Swapan Kumar Majumdar, Mr. Saptarshi Majumdar ...for the respondent nos. 3 and 4 The writ petition has been filed challenging the FIR being Nabadwip Police Station Case No. 557/22 dated 19.11.2022.

The Nabadwip Municipality alleged that the petitioners have occupied land belonging to the Municipality. There are also some issues with regard to the conversion of the land.

This Court does not find any serious impropriety in the registration of the FIR calling for any interference under Article 226 of the Constitution of India at this stage.

The petitioners may take out either civil, statutory or any other proceedings in accordance with law in respect of the subject matter of this writ petition.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

The report of the Nabadwip PS dated 09.01.2023 is kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
