A direction to secure expeditious disposal of an interlocutory application praying for repairing filed on 27.01.2020 filed in Title Suit No. 742 of 2018 pending before the learned Civil Judge (Junior Division), 1st Court, Sadar, Paschim Medinipur, is the ultimate relief sought for in this case.

As per submission disclosed by the petitioner, such application has already been posted for hearing on 31.01.2023.

No other point is raised requiring address by this Court.

The only contention expressed by the petitioner is against the delay caused in the disposal of interlocutory application.

In view of the nature of the order proposed to be made in the case, no prior notice is considered to be necessary.

Service upon the opposite parties is thus dispensed with.

Accordingly, learned Civil Judge (Junior

Division), 1st Court, Sadar, Paschim Medinipur in Title Suit No. 742 of 2018 is requested to ensure expeditious disposal of the pending interlocutory application, referred hereinabove, either on the date already scheduled by the Court below, or if for any reasons whatsoever, the same could not be taken up, the application may be taken up peremptorily within three weeks thereafter, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
