And In the matter of: Rocky Sk @ Reyan Habib ....Applicant/Petitioner Mr. Kushal Kumar Mukherjee Mr. Sayan Das ...for the petitioner Ms. Sonali Das Ms. Sanjida Sultana ..for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case merely on the basis of a last seen together account. The wife/de facto complainant alleged that the petitioner had left telling her that he was to meet one Jasimuddin.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She refers to the materials available in the case diary including the post-mortem report and the statement of a witness present at page 23 of the case diary. According to such statement that gives out a last seen together account, the said Jasimuddin also was there with the petitioner and others having discussion with the victim.

Considering the above and the other materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
