W.P.A. 26019 of 2015 rkd 26.04.2023 Ct.15 Tapas Kumar Chowdhury & Ors.
-vsState of West Bengal & Ors.
Mr. Tirupati Mukherjee ....for the petitioners.
Mr. N. C. Bihani, Mr. Soumyajit Ghosh ....for the North Dum Dum Municipality.
At the time of call accommodation has been prayed for on behalf of the petitioners.
However, North Dum Dum Municipality is represented by learned advocates.
It appears that on 19th April, 2023 on the prayer being made for adjournment on behalf of the petitioners the same was allowed and the matter has been fixed for hearing today. It has also been specifically mentioned in the order dated 19th April, 2023 that no further adjournment shall be granted on the next date.
In view of aforesaid position prayer for adjournment which has been made today on behalf of the petitioners stands refused.
Since no submission is made on merit of the writ petition, it appears that petitioners have lost interest.
The writ petition stands dismissed.
Interim order, if any, stands vacated.
Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
