Perused the affidavit-of-compliance filed by the Secretary, West Bengal Board of Primary Education. It appears therefrom that the issue of setting up and validity of the CMJ University, Meghalaya is pending consideration before a Special Bench constituted by the Hon'ble Supreme Court. The petitioner seeks benefit relying upon an educational certificate issued by the said University.

Till the Special Bench of the Hon'ble Supreme Court decides the issue of the validity of the University, the certificate issued by the said University cannot be relied upon for the purpose of obtaining service.

In view of the above, there is no scope to proceed with the contempt application at this stage.

The same stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
