AND In the matter of:- Namita Mandal ... petitioner Mr. Arijit Ganguly, Mr. Sandip Chakraborty ...for the State The present revisional application has been preferred against the order dated 31.05.2019, passed by the learned Additional Chief Judicial Magistrate, Basirhat, wherein, learned court was pleased to discharge accused/opposite party nos.2 to 6 from the case arising out of Hingalganj Police Station Case No.157 of 2018 dated 05.11.2018.
Mr. Arijit Ganguly, learned advocate appearing for the State submits report from the concerned Officer of Hingalganj Police Station. Report so submitted be kept with the record. Report reflects that next date has been fixed by the learned Judicial Magistrate, 1st Court, Basirhat on 25.10.2021. Learned court is directed to expeditiously proceed with the trial of the case and in case the evidence surfaces against the
opposite party nos.2 to 6 during the trial the learned Magistrate would be at liberty to invoke the provisions of Section 319 of the Code of Criminal Procedure. At this stage, I do not find any reason to interfere with the order so passed by the learned Magistrate. With the aforesaid observations, C.R.R.3836 of 2019 is disposed of.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
