Pursuant to the complaint which was addressed by the petitioner to the Officer-in-Charge, Chandannagar Police Station dated 08.10.2024 regarding the no-objection certificate to be given by the respondent no.4, namely, one Rishav Mukherjee, learned advocate appearing for the respondent no.4 submits that the respondent no.4 is ready with the no-objection certificate to be handed over to the petitioner but the main problem arise as the funds were transferred from a partnership firm called Premium Autos and the petitioner is claiming for the no-objection certificate. It has also been submitted by

the respondent no.4 that the petitioner is not a partner of the aforesaid partnership firm.

Be that as it may, since the police authorities have already registered case being Chandannagar P.S.

Case No.208 of dated 11.11.2024, respondent no.4 will hand over the no-objection certificate to the investigating officer of the case. If the petitioner is able to satisfy the investigating officer regarding his claim for receiving the no-objection certificate, the investigating officer of the case on being prima facie satisfied would hand over the no-objection certificate to the petitioner, informing the jurisdictional court in seisin of the matter.

Having considered the subject matter of the case which relates to the no-objection certificate only, in case the same is resolved, the investigating officer will unnecessary not pursue the criminal case which has been registered so far as the respondent no.4 is concerned.

With the aforesaid observations, WPA 26731 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted by the State be kept with the record.

Copies of the report be handed over to the learned advocate appearing for the petitioner and the private respondent no.4.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
