AND In the matter of:- Rina Biswas ... petitioner The subject-matter of challenge in this revisional application is the order dated 05.01.2013, passed by the learned Sessions Judge, 3rd Court, Krishnagar, Nadia, in Criminal Motion No.81/11.

The learned court after reassessment of the evidence in a proceeding under Section 125 of the Code of Criminal Procedure was pleased to remand the case to the learned Magistrate with a direction to emphasize on the deposition of prosecution witness no.3 and reconsider the case afresh with a liberty to adduce fresh evidence by the parties.

Having regard to the fact that the present revisional application is pending for more than seven years and no information being furnished before this Court regarding the present stage of the proceedings and fresh consideration by the learned Magistrate pursuant to the order passed by the learned

Sessions Court, I am of the view that the revisional application has become infructuous.

Accordingly, C.R.R.3030 of 2013 is dismissed. Pending application, if any, is consequently disposed of. All parties shall act in terms of copy of this order downloaded from the official website of this Court.
