Mr. Tanoy Chakraborty Mr. Chhandak Dutta .....For the Petitioner Ms. Tuli Sinha ....For the State The Commissioner of School Education has held that he is not appropriate authority to decide this matter relating to shortfall in qualifying service for getting pension.

I direct the Principal Secretary, Education Department, Government of West Bengal to look into the matter and to see whether the shortfall can be condoned or not. After hearing the petitioner one reasoned and speaking order is to be passed by six weeks from the date of communication of this order and communicated the same to the petitioner thereafter.

With this observation and direction the writ application is disposed of.
