In the matter of : An application under Section 482 of the Code of Criminal Procedure.

The present revisional application has been preferred by the husband against the order dated 2nd March, 2013 passed by the learned Judicial Magistrate, 1st Class, Municipal Court, Howrah wherein in a case under Section 125 of the Code of Criminal Procedure being Miscellaneous Case No. 506 of 2011, the learned Magistrate was pleased to allow the application and awarded maintenance of Rs.1200/- per month to the wife and Rs.800/- per month to the minor son. While passing such order, the learned Magistrate took into account the earning of the husband as well as the relationship and the minimum expenditure required for an individual to survive.

Having regard to the consideration which weighed with the learned Magistrate in passing the order dated 2nd

March, 2013 which was passed by way of an interim measure during the pendency of the final disposal of the application under Section 125 of the Code of Criminal Procedure, I am of the view that no interference is called for by this court. Accordingly, the present revisional application being CRR 3036 of 2013 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
