Dr. Sutanu Kumar Patra Ms. Supriya Dubey ...for the WBCSSC Writ petition is taken up for consideration when accommodation has been prayed for on behalf of the petitioner since the learned advocate representing the petitioner is not present in Court.
It has been submitted by Dr. Sutanu Kumar Patra, learned advocate representing the Commission that matter relates to transfer of an assistant teacher working in a Government aided secondary school on the ground of distance.
On perusal of the writ petition it appears that the petitioner applied for general transfer on the ground of distance in between the place of residence of the petitioner and his present school on 14th July, 2022 and the same was forwarded by the school authority where petitioner was serving on 14th September, 2022 on compliance of formalities to the concerned District Inspector of Schools (SE), Jhargram and thereafter the District Inspector of Schools in his turn processed the transfer application of the petitioner and forwarded the
same to the office of the West Bengal Central School Service Commission on 20th September, 2022. It further appears that in spite of forwarding the transfer application of the petitioner by the concerned District Inspector of Schools far back on 20th September, 2022 to the Commission till date no decision has been taken by the Commission.
Commission is represented by learned advocate who submits that perhaps due to suspension of Utsashree Portal with effect from 29th September, 2022 contemporaneous decision could not be taken on the transfer application of the petitioner and if necessary direction is given upon the concerned authority of the Commission the transfer application shall be decided in accordance with law.
Having considered the submissions made on behalf of the Commission and taking note of the materials available on record the writ petition stands disposed of directing the concerned authority of the West Bengal Central School Service Commission to decide the transfer application of the petitioner in accordance with law by 4 (four) weeks from date and the decision which is to be taken on behalf of the Commission shall be communicated to the petitioner by 1 (one) week thereafter.
It is made clear that the transfer application of the petitioner shall not be rejected on the ground of suspension of Utsashree Portal.
There shall be no order as to costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
