Mahata ....for the State The grievance of the petitioner is directed against the acquisition proceeding being L.A.Case No. 06 (NHAI) of 2009-10 initiated by the Land Acquisition Authorities. It is submitted by the Advocate appearing on behalf of the State-respondents the final award of the L.A.Case No. 06(NHAI) of 2009-10 has been passed in this subject land and the petitioner has been awarded compensation aggregating to a sum of Rs.10.00 Lakhs (approximately). Mr. Das, Advocate appearing on behalf of the National Highway Authority of India submits that since the petitioner has an efficacious, alternative, statutory remedy, this writ petition is not maintainable. Heard the parties.
In view of an efficacious, alternative, statutory remedy available to the petitioner there is no scope of entertaining this writ petition.
However, liberty is granted to the petitioner to avail the efficacious, alternative, statutory remedy in accordance with law.
It is made clear that I have not gone into the merits of this case and the appropriate forum is directed to consider the case of the petitioner, if approached, in accordance with law.
WPA No. 27620 of 2017 is dismissed.
There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
