Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and he has been implicated in the case because of his motorcycle being used by some of the accused persons and the said motorcycle was used without his knowledge for commission of the alleged offence. Learned advocate for the State on the other hand produces the Case Diary and draws the attention of the Court to the statement of the injured victim under Section 164 of Cr.P.C./183 of BNSS.
I have taken into account the statement of the injured and I am of the view that without the deposition/evidence of the injured before the learned trial Court it would not be fair at this stage to consider the prayer for bail of the petitioner in his favour.
Consequently, the prayer for bail of the petitioner being CRM (M) 2426 of 2025 is dismissed.
Learned trial Court is directed to complete the evidence of the injured victim by 31st of March, 2026. Petitioner would renew his prayer for bail after the said period is over.
Liberty is granted to the State to communicate this order to the learned trial Court.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
