The petitioner complains that the private respondent No.8, landlord has illegally taken possession of her car. 2.

There are disputes and differences between the petitioner and the private respondent in connection with tenancy.

Learned counsel for the State has produced a report in the form of instructions issued by the Inspector-inCharge, Maheshtala Police Station addressed to the learned Government Pleader and the same is taken on record.

It appears that the petitioner has voluntarily handed over the car to the private respondent against a written agreement. The private respondent has also filed a petition for recovery of dues before the Judicial Magistrate, 2nd Court, Alipore in AC-2774/22 and TR975/22. 5.

In that view of the matter, this Court is of the view that the writ petitioner has tried to mislead this Court.

The writ petition is, therefore, dismissed with costs assessed at Rs.7,500/- payable by the petitioner to the Maheshtala Police Station.
