Sarkar, Ms. Anshumala Bansal ...for the petitioner Mr. Naba Kumar Das, Mrs. Diana Ghosh Dastidar ...for the State The grievance of the petitioner in the writ petition is against the delay on the part of the respondent no.2, Land Manager, Bidhan Nagar, Department of Urban Development and Municipal Affairs, Government of West Bengal to mutate his name in respect of the premises no. CF - 337. Sector -1, Salt Lake City (Bidhan Nagar), Kolkata - 700064 (hereinafter referred to as the 'said property').

From the documents disclosed in the writ petition it appears that in terms of a direction dated February 1, issued by the respondent no. 2, the petitioner has already deposited the mutation fee of Rs. 26,21,842/-

with the Urban Development Department, Government of West Bengal.

The respondent no. 2 has already started to hold the hearing to decide the claim of the petitioner to mutate his name in respect of the said property. The supplementary affidavit filed by the petitioner today discloses that the last hearing was held by the respondent no.2 on October 7, 2020.

Considering the facts of the case, I do not find any reason to keep the writ petition pending before this Court.

Accordingly, WPA 23982 of 2019 is disposed of by directing the respondent no. 2 to decide the claim of the petitioner for mutating his name in respect of the aforementioned property within four weeks from the date of communication of this order.

Since the respondents are not called upon to file any affidavit, the allegations made against them in the writ petition, if any, shall be deemed not to be admitted.

All parties shall act in terms of the copy of the order downloaded from the official website of this Court.
