Petitioners are aggrieved by the fact that in spite of representation made on 30.10.2024 to the Inspector-in-Charge, Baguiati Police Station, no steps were taken by the police authorities.

Petitioners complain that they have been thrown away from their residence.

State has submitted a report which reflects that the petitioners' complain of being thrown away from the residence at the relevant date is not substantiated. However, the tenor of the police report reflects that there is family feud between the petitioners and their son-in-law and daughter-inlaw. Having considered that there are specific provisions under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, petitioners

be well advised to approach the Maintenance Tribunal/SDO with relevant prayers for restoration of possession. If a direction is passed by the SDO upon the police authorities, the police authorities would take steps in accordance with law.

With the aforesaid observations, the writ petition being WPA 26756 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
