Heard learned lawyers for the parties.

We have considered the materials on record. Petitioner is in custody for four months. Though allegations are grave, we are of the opinion further detention of the petitioner for progress of trial is not necessary and he may be granted bail.

Accordingly, the petitioner be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned ACJM Barrackpore North 24 Parganas on condition that the petitioner shall appear before the trial court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that the petitioner while on bail shall not enter the jurisdiction of Dum Dum P.S except for attending court proceeding and provide address where he shall presently residing to the investigating agency and to the trial court and shall report to the Officer-inCharge of the police station concerned where he shall presently residing once in a week until further orders. In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. 5.
