Nilam ...for the State-respondents Supplementary affidavit filed by the petitioner and report submitted by the State are taken on record. Initially the petitioner sought direction upon the police authority to grant them permission to hold an Islamic Jalsa on November 30, 2025 in Gopalnagar Haripada Institution Maidan. The police informed that since November 30, 2025 was fixed for examination for recruitment to the post of constables in West Bengal and Gopalnagar Haripada Institution is one of the centres for the said examination, an alternative date may be fixed for the Jalsa. Accordingly, the petitioner shifted the date
to December 7, 2025 from 8.00 am. to 8.00 pm. The police authority has no objection if the programme is held on the said date subject to compliance with other requisite formalities.
In view of the above, the petitioner is permitted to hold the Islamic Jalsa on December 7, 2025 from 8.00 am. to 8.00 pm. subject to the following conditions. (i) The number of participants in the Jalsa shall not be more than 1000 at any point of time.
(ii) The Jalsa shall be held peacefully without use of any foul language or incitement of violence.
(iii) The sound system which may be used therein shall be within the permissible limits.
(iv) The petitioner shall provide the names and mobile phone numbers of at least four organizers who shall be responsible for any untoward incident.
The police authority shall deploy adequate number of police personnel to ensure that there is no breach of peace.
The programme should not cause any inconvenience to the public, passersby or the
neighbourhood. The participants shall disperse within one hour of completion of the programme.
The ground shall be restored to its original condition within two days of completion of the programme.
With the said observation, the writ petition is accordingly disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
