Mr. Tanmoy Bhattacharya Mr. Somnath Das Ms. Mithu Mullick ... for the petitioner This is an application filed by the petitioner praying for expeditious disposal of Title Suit No. 165 of 2017 presently pending before the learned Civil Judge (Junior Division), 2nd Court, Howrah.

Petitioner contended that since the initiation of the proceeding though trial commenced but it has been stalled for a considerable period of time when only examination of P.W. 1 was completed.

In such circumstances, a direction may be passed upon the Court below for expeditious disposal of the said suit. Since the prayer made on behalf of the petitioner is innocuous and if an order is passed in terms of the prayer made in the said application, the opposite party will have no cause to prejudice the service of copy of application or notice upon the opposite party is dispensed with.

Having considered that the prayer made on behalf of the petitioner is justified, C.O. 3864 of 2024 is hereby disposed of with a direction upon the Court below to make every endeavor for expeditious disposal of the suit and to make best effort to conclude the entire proceeding of the pending T.S. No. 165 of 2017 preferably within a period of six months from the date of communication of this order. With the above observation, C.O. 3864 of 2024 stands disposed of.
