Sarkar ... for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the case relates to 188 bottles of phensedyl having been recovered and the same were not from the possession of the petitioner who has been implicated as motor cycle has been found which allegedly was used during commission of the offence.
Learned advocate further submits that the petitioner is in custody for about four months.
Learned advocate for the State opposes the prayer for bail and submits that the petitioner is part of the group and he fled away from the spot and the said motor cycle was used for commission of the alleged offence.
Learned advocate also submits that the petitioner was shown arrested in connection with another case, as such, he has antecedents.
Having considered the period of detention of the petitioner and the fact that the contraband was not recovered but only motor cycle has been recovered from the petitioner as also the fact that some of the accused persons are absconding, further detention of the present petitioner, according to this court, is unwarranted.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Ichhab Mondal @ Esab Mondal @ Ichhab Ali Mondal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court under NDPS Actcum-Additional Sessions Judge, 5th Court, Berhampore, Murshidabad.
If on bail, the petitioner shall make himself physically available on each and every date so fixed by the learned trial court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned trial court. The petitioner shall also meet with the Inspector-incharge/officer-in-charge of Jalangi Police Station once in a
week till the conditions are waived by the learned Special Court.
Accordingly, CRM(NDPS) 1487 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
