The petitioner is an Assistant(accounts and cash) with the State Bank of India, Burdwan Branch.

He is covered under the Bipartite Settlement/Sastri Award and is a workman within the meaning of the Industrial Disputes Act, 1947. 3.

The petitioner challenges an order of suspension in aid of departmental proceedings initiated against him under the bipartite settlement. 4.

Since the petitioner is a workman and has effective alternative remedy before the Industrial Tribunal under the provision of the Industrial Disputes Act, 1947, the writ petition is not entertained.

It is, however, made clear that this Court has not gone into the merits of the petitioner's claim and the same may be independently decided, by the appropriate forum, if approached, in accordance with law.

The writ petition is disposed of.

There will be no order as to costs.
