Mr. Avishek Prasad, learned advocate for the Malda D.P.S.C. files the instruction bearing Memo No. 4270/MDPSC/24 dated December 17, 2024, which he has received from the Chairman of the said Council. It appears from the said instruction that the petitioner is a surplus teacher in her present school. The petitioner is praying transfer to any other school under a different Circle of the said council on the said ground of surplus teacher.

A representation of the petitioner dated October 07, 2024 to the said effect is pending consideration before the Chairman of the said council, the respondent no. 3 herein.

The said respondent is directed to consider the said representation of the petitioner only on the ground that the petitioner is a surplus teacher in her present school and shall dispose of the same in accordance with law.

WPA 26873 of 2024 is disposed of with the above terms without any order as to costs.
