1. Being faced with the report of the office that the appeal is below the pecuniary jurisdiction of this Court being valued at Rs.60,100/-, the learned counsel does not wish to press this application with leave to avail the appropriate remedy in accordance with law.

2. We have considered the office report. The appeal being barred in view of the provision laid under Section 21(1)(a) The Bengal, Agra and Assam Civil Courts Act, 2000, we allow the learned counsel for the appellant to withdraw the appeal with liberty to file the appeal before the appropriate forum.

3. The application is accordingly dismissed as withdrawn.

4. The certified copy may be returned to the learned counsel for the appellant by the ACO on submission of a photocopy thereof.
