(VIA VIDEO CONFERENCE) Mr. Soumitra Das ....for the petitioner Mr. Chandi Charan De Mr. Anirban Sarkar ...for the State The grievance of the petitioner is directed against the proceeding pending before the Block Land and Land Reforms Officer being the respondent no. 5 herein. It is submitted by the Advocate appearing on behalf of the petitioner that notwithstanding an order passed in Appeal No. 115 of 2014 by the Appellate Authority under Section 54 of the West Bengal Land Reforms Act, 1955 the respondent no. 5 has taken no steps to finally dispose of the subject proceedings pending before him.
Mr. De, Advocate appearing on behalf of the Staterespondents submits that he has no objection if the direction is passed on the respondent no. 5 to consider and dispose of the proceeding pending before him within three months from date.
In view of the submission made by the parties, I direct the respondent no. 5 to dispose of the proceedings which was remanded back in terms of the order dated 02.12.2015 passed in Appeal Case No. 115 of 2014 be
disposed of within a period of three months from date after giving a right of hearing to all the affected parties and in accordance with law.
It is made clear that I have not entered into the merits of this case and the respondent no. 5 will not be influenced by any observation on the merits of this case. It is also made clear that after disposing of the representation of the petitioner the respondent no. 5 will communicate his reasoned order to all concerned who have been heard.
Since no affidavit in oppositions are filed the allegations contained in the petition are denied. With the above observations and directions this writ petition being WPA No. 24038 of 2019 stands disposed of. There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
