The petitioners allege that the respondent no. 8 was wrongly given the contract for supply of cooked Mid-Day-Meal under the Swarnajayanti Gram Swarojgari Yojona. According to the petitioners, the self-help groups which were registered earlier, ought to have been given a preference. The respondent no. 8 having been registered as a self-help group later than the petitioners, could not have been selected for supply of the cooked Mid-Day-Meal.

The petitioners have not been able to satisfy that such system had been followed either by way of convention or by virtue of any memorandum, circular or policy, which have been issued in this regard. Under such circumstances, no order can be passed in this writ petition. It is not the case of the petitioners that they are the existing self-help groups

who have been denied the opportunity to continue with the service.

The petitioner submits that on April 21, 2022 a final selection list of 20 self-help groups under the Kultali Development Block, had been published by the Block Development Officer. The name of the petitioners were excluded, without any reason. The petitioners approached the Block Development Officer, Kultali by filing a representation. The same is yet to be disposed of. It appears that the petitioners approached the authorities under the Right to Information Act, but no reply had been received. Under such circumstances, the writ petition is disposed of with a direction upon the Block Development Officer, Kultali to intimate the petitioners the reason as to why the names of the petitioners had not been included in the final selection list of the 20 the self-help groups in connection with supply of cooked Mid-Day-Meal under Kultali.

The intimation shall be sent to the petitioners within a period of two months from the date of communication of this order.

A copy of the writ petition along with the copy of this order, shall be served upon the concerned Block Development Officer.

Accordingly, the writ petition is disposed of.

However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
