The petitioner has filed the present writ application praying for a direction upon the respondents, particularly, the respondent no. 5, i.e., the Executive Engineer, PWD, Murshidabad, Murshidabad Electrical Division, Berhampore for release of the outstanding amount of Rs. 16,04,809/-.

Learned counsel for the petitioner submits that on April 6, 2021, the Executive Engineer, PWD, Murshidabad, Murshidabad Electrical Division, Berhampore had issued the work order for urgent requirement of Infrastructure and Logistic Support to the CAPF/SAP to be deployed at 10 numbers premises under Jalangi Police Station. As per the work order issued to the petitioner, the petitioner has executed the work and the Executive Engineer, PWD, Murshidabad, Murshidabad Electrical Division, Berhampore had issued the completion certificate on November 10, 2025 certifying that the petitioner had completed the work satisfactorily in all respects and terms and conditions.

The petitioner submits that though the expected tender value of rupees is Rs. 21,48,778.54 but the petitioner has
executed the work for a total amount of Rs. 19,33,805/-. Out of the total amount, the authorities have released the part amount and the balance amount of Rs. 16,04,809/- is still pending.
The petitioner has made several representations but the respondents have not paid this amount.

Considered the submissions made by the learned counsel for the petitioner.

In spite of service of notice, none appears on behalf of the State.

This Court finds that the authorities have admitted the claim of the petitioner that the petitioner has executed the work for a total sum of Rs. 19,33,805/- out of this, the authorities have only paid the amount of Rs. 3,28,996/- on March 18, 2024 and, thereafter, the authorities have not paid the balance amount of Rs. 16,04,809/- 7.
Considering the above, the respondent no. 3 is directed to immediately approve the amount of Rs. 16,04,809/- for payment of the said amount to the petitioner and once, the said amount is approved by the respondent no. 3 the respondent no. 5 shall pay the said amount.

The entire process shall complete within a period of eight weeks from the date of the receipt of this order. 9.
WPA 26557 of 2025 is disposed of.
10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
