Learned advocate appearing for the petitioners submits that the petitioners are the electricians who have been falsely implicated in connection with Taltala Police Station Case No. 90 of 2019. There are other additional issues which have been canvassed by the learned advocate appearing for the petitioners including the factum of the name of the petitioners being absent in the statement recorded under Section 164 of the Code of Criminal Procedure as well as in some of the statement recorded under Section 161 of the Code of Criminal Procedure.

Having considered the contentions so advanced, I am of the view that the petitioners would be at liberty to agitate the issues in the present revisional application at the time of consideration of charges before the learned trial court. Learned trial court would independently consider the same without being influenced by any observations made by this Court.

With the aforesaid observations, the revisional application being CRR 4385 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
