Petitioners are aggrieved by the fact that in spite of an ad interim injunction being passed by the learned Civil Court, Senior Division, 1st Court, Contai wherein the learned civil Court is pleased to pass a direction of status quo in respect of nature and character of the schedule property, construction is being carried out at the behest of the respondents in violation of the civil Court's order.

Learned advocate for the State and the private respondent are present.

Petitioners would approach the civil Court in respect of violation of its order and/or direction upon the police authorities. In case, the Court is of the opinion that such a direction is to be passed, the police authorities under such circumstances would respect and obey the civil Court's order.

In the meantime, police authorities would ensure that there is no breach of peace and tranquility at the behest of both the parties.

With the above observations, WPA 26798 of 2024 is disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
