Mrs. Subhasree Patel ... For the State Learned advocate appearing on behalf the petitioner submits that allegedly from the joint possession of the petitioner another 46.919 kgs. of Ganja were recovered from the petitioner. The petitioner is in custody for 732 days and although charge sheet has been submitted but there is no progress in the case.

Learned advocate appearing for the State submits that all steps would be taken for overcoming the stage of consideration charges on the date so fixed.

Having considered the quantum of recovery, I am of view that the rigors of the Section 37 of the NDPS Act is attracted. As such the prayer for bail of the petitioner is rejected.

The application for bail, being CRM (NDPS) 1488 of 2025, is, thus, dismissed.

However, Learned Trial Court is directed to overcome the stage of consideration of charges on the next date so fixed or within a week thereafter. After framing of charges, the learned Trial Court would see into it that on priority basis the examination of the seizure list witnesses should be completed within a period of 60 days from the date of framing of charges. The petitioner will renew his prayer for bail after the evidence of seizure list witnesses. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
