1. This is an application for condonation of delay. There is a delay of 20 days in presenting the memorandum of appeal.

2. Sufficient cause being shown for not being able to file the appeal within the time of stipulation, the delay of 20 days in presenting the memorandum of appeal is condoned.

3. CAN 2 of 2023 is, accordingly, allowed.

4. We have heard the learned Counsel for the parties.

5. The application for compassionate appointment was considered during post-graduation. Accordingly, the allegation made in paragraph 3(d) of the application is not sustainable. In any event, he has accepted the said post and it has been fully consummated. In any event, the matter is covered by the judgment of the Hon'ble Supreme Court decided in State of Rajastan vs. Umrao

Singh reported in (1994) 6 SCC 560.

6. With the aforesaid observation, the appeal and the application are disposed of.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
