Learned advocate representing the West Bengal Central School Service Commission submits, upon instruction that, the vacancy in the school where the petitioner ranked 'one' in the year 2022 is no longer available.

As the petitioner seeks transfer on medical ground and crossed all the hurdles to reach rank 'one' in one of her opted schools, but the recommendation could not be made because of suspension of the portal, accordingly, the Court thinks it fit to direct the Secretary of the West Bengal Central School Service Commission to grant an opportunity of hearing to the petitioner at the earliest but positively within a period of four weeks from date to ascertain whether she can be recommended to a school which is close to her opted school.

If any school is available for transfer of the petitioner, then necessary recommendation shall be made without any further delay.

Suspension of the Utsashree portal will not stand in the way of the respondents to consider the prayer for transfer made by the petitioner.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
