Learned advocate appearing for the petitioner submits that the petitioner is in custody for 220 days and the promoter being the principal accused has already been arrested. Learned advocate for the State on the other hand opposes the prayer for bail and submits that the present petitioner was absconding for a considerable period of time. The investigation of the case is still in progress. In the initial charge sheet 7 persons were made accused.

Petitioner having absconded for a considerable period of time cannot claim the same benefit as the other accused who has been granted bail. Further it reflects that in the order dated 14.10.2025 the bail was granted without considering the case diary.

Having regard to the same and the stage of the case while the investigation is in process, I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 2428 of 2025 is dismissed at this stage.
