Bulandshahr Case No.0061 of 2024 dated 24.12.2024 under Section 66D of the Information Technology (Amendment) Act, 2008 read with Section 318(4) of the BNS, 2023.

Monirul Gazi ... petitioner Md. Shamimuddin Sk. Samiul Haque Mr. Raunak Shaw ... for the petitioner Mr. Rudradipta Nandy Mr. Subhasish Datta ... for the State Supplementary affidavit filed by the petitioner is taken on record. Copy of the same be handed over to learned counsel for the State.
Learned counsel for the petitioner submits that the petitioner was minor at the time of alleged occurrence. He could not have had bank account of his own. If he goes to the State of Uttar Pradesh to seek appropriate relief, he will be harassed unnecessarily.
Learned counsel for the State opposes the prayer for transit anticipatory bail and submits that it will be for the investigating agency of the State of Uttar Pradesh to verify the authenticity of his birth certificate. He relies on the
report sent by the Inspector of Cyber Crime Police Station, District Bulandshahr, Uttar Pradesh.
It appears that a notice was given to the petitioner under Section 35(3) of the BNSS.
Considering the above, let the petitioner not be arrested for a period of six weeks from this date. Within the said period of six weeks, the petitioner shall be at liberty to take appropriate steps before the concerned Courts in the State of Uttar Pradesh including filing a regular application for anticipatory bail.
The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
