C.R.M. (A) 4984 of 2023 30.01.2024 DL-63 Court No.29 (AD) (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Coke Oven Police Station Case No.117 of 2023 dated 05.08.2023 under Sections 498A/323/325/307/406/34 of the Indian Penal Code, 1860 and 3/4 of Dowry Prohibition Act (G.R. Case No.1378 of 2023).

And In the matter of: Pintu Sekh & Anr.

....petitioners.

Mr. Moniruzzaman ... for the petitioners.

Mr. Saibal Bapuli, Ld. APP Mr. S. Ganguly ...for the State.

Police case was filed within four years of marriage. There is an injury report of the de facto complainant. Statements of independent persons suggest that there was continuous demand for dowry made by the petitioners from the de facto complainant and her family members. Moreover, petitioners were also involved in meting out torture to the de facto complainant.

In such circumstances, we are unable to grant anticipatory bail to the petitioners.

Accordingly, the prayer for anticipatory bail of the petitioners is rejected.

C.R.M. (A) 4984 of 2023 is dismissed.
