M/S Tescon A Partnership Firm And ANR v. The P.N.B. And ORS
Court No. 1 (266111) MAT 2203 of 2023 M/s. Tescon, a partnership firm & Anr.
16.07.2024 Vs.
The PNB & Ors.
(AD 30) (S. Banerjee/AN) CAN 1 of 2023 CAN 2 of 2024 Mr. Siddhartha Banerjee Mr. Debasish Chakraborty Mr. Shashwata Nayak ...for the respondent-Bank 1.
None appears for the petitioner, although the respondent-Bank is represented.
2.
Upon going through the facts as well as the reasoning recorded by the learned Single Bench, more particularly in paragraph nos. 2 and 3 of the impugned order, we find that the order passed in the writ petition does not call for any interference. The learned Single Bench rightly noted about the pendency of the civil proceeding before the Commercial Court as well as the Original Application filed by the bank before the appropriate forum. 3.
Hence, no ground have been made out to interfere with the impugned order.
4.
With the above observation, the appeal stands dismissed.
(T. S. Sivagnanam) Chief Justice (Hiranmay Bhattacharyya, J.)
