Petitioners are aggrieved by the fact that inspite of adhering to the order passed by the coordinate Bench of this Court in WPA 13065 of 2023, petitioners were forced to suffer injury because of the acts and actions of the anti-socials who indulged in looting the fish in spite of the petitioners having legal right over the same. Petitioners reported incidents to the Inspector-inCharge, Ratua Police Station, Malda. Mr. Sen, learned Additional Advocate General appearing for the State has submitted a report and submitted that there were certain disturbances for which the police authorities have taken steps.

Accordingly, Ratua PS Case No. 606/24 dated 07.11.24, Ratua PS Case No. 601/24 dated 06.11.24 and Ratua PS Case No. 607/24 dated 07.11.24 have been registered for investigation.

In view of the disturbances prevailing, I direct the Inspector-in-Charge of Ratua Police Station to keep a strict vigil and to prevent any untoward situation. Petitioners should not be deprived of the right which has accrued and enjoyed pursuant to the permission which have been granted to them.

Since the investigation in respect of number of cases have commenced, the police authorities are directed to take the same to its logical conclusion within a reasonable period of time.

With the above observations, WPA 26824 of 2024 is disposed of.

Report submitted by the State be kept with the record. Copy of the same has been handed over to learned advocate for the petitioners.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
