The instant application has been filed with a prayer for condonation of delay of 21 days in filing the Special Leave Petition to file appeal against the judgment and order of acquittal passed by the learned Additional Chief Judicial Magistrate, Alipore, South 24Parganas in connection with Complaint Case No. AC 3895 of 2015 under Section 138 of the Negotiable Instruments Act. 2.

Perused the explanation of delay in paragraph 2 of the instant application.

Learned advocate on behalf of the opposite party no.1 raises formal objection.

Considering the reasons explained in paragraph 2 of the application, the prayer for condonation of delay stands allowed. The delay is condoned.

The application, being CRAN 1 of 2023, stands disposed of. In re: CRMSPL 69 of 2023 8.

The special leave petition is filed with a prayer for filing appeal against the judgment and order dated 20th July, 2023 passed by the learned Additional Chief Judicial Magistrate, Alipore, South 24Parganas in connection with Complaint Case No. AC 3895 of 2015 under Section 138 of the Negotiable Instruments Act on. 9.

I have carefully perused the judgment passed by the learned Additional Chief Judicial Magistrate, Alipore, South 24-Parganas and leave is granted to prefer an appeal within the statutory period. 10.

With the aforesaid observation, CRMSPL 69 of 2023 stands disposed of.
