No. 142, Mouza - Chaity, Paikar Police Station, Birbhum.

The petitioners allege that they have the necessary permission from the local Panchayat Authority as appearing at page 32 of the writ petition.

It is submitted that the Zilla Parishad is not granting permission to organise the fair.

Learned advocate appearing for the Zilla Parishad submits that the petitioners do not have the required permissions from various authorities, in particular the Fire Department, to organise the fair.

It is submitted that if the fair is allowed to be organised without such permission, it may pose a serious threat to the

safety and security of the local people.

Learned advocate appearing for the petitioners, however, could not produce a fire permission from the concerned department.

The concern of the Zilla Parishad cannot be ignored. A fair of this nature should be organised only after due precautions, particularly obtaining a fire licence. In view of the above, this writ petition is disposed of, granting liberty to the petitioners to apply for a fire licence forthwith. The Fire Authority shall consider the application in accordance with law within a period of 48 hours from the date of filing.

If the Fire Authority grants the necessary permission, the Zilla Parishad shall grant the required permission to hold the fair in accordance with law.

It is also clarified that the organiser shall be permitted to conduct the fair only upon obtaining an electricity connection from the competent authority.

Accordingly, WPA 26381 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
